On may 3, 2010, the department of license & inspections issued a notice of refusal for application #269698.

The department of licenses and inspections findings must be reversed and the violation must be vacated.

Expansion of the existing steel framed casino building with a two story (plus penthouse). Steel framed addition and a seven story , precast parking garage. Associated sitework, landscaping, flatwork and roadway work will also be performed.

For the enclosure of a "open" terrace, the erection of a one (1) story addition (modular office), additional roof top mechanicals penthouses and the erection of five (5) signs, size and location as shown in application. All accessory to an existing casino complex to include 1,7 slot machines and a nite club on the first floor with accessory offices on the second floor (mezzanine) with accessory storage and food prep throughout, revise parking to 1081 total, 37 accessible and 317 compact spaces. ( total accessory parking on ap # 269718 , 1516 spaces ).

Rough grading site work permit only. Excavation grading of the site (uplands only) to support the construction of phase i improvements, as noted in the attached earthwork package of plans. Work shall include, but not be limited to, excavation, removal of existing surface and subsurface features, and installation of erosion and sedimentation controls, pursuant to the approved dep e&s plans. Work shall not commence in the remaining areas of archeological concern until clearance is obtained from the phmc and usace.

Lowest floor elevation (18) inches min. Above base flood elevation. For use as assembly & entertainment casino, nightclub & private club, sit-down restaurant, & personal services (spa w. No activity as defined in 14-601(7)(a)(. 4)) as an expansion of an exist. Gaming facility, with all other uses as previously approved, w. Accessory off-street parking for (2,611) space, including (48) accessible spaces & (11) van accessible spaces, & accessory signage as previously approved. Preliminary plan review for expansion of existing casino building and the construction of a 15 parking space garage.

For the erection of an addition to an existing building, addition to extend the use of an existing eat-in restaurant. All work to be done per approved plans. Building to be fully sprinklered. Separate permits required for mechanical,electrical and fire supression work.

For the erection of a three (3) ten (10) eleven (11) story structure with canopies and for the erection of three (3) generators. Size and location as shown in the application. For a casino complex for uses as permitted in the commercial entertainment district to include licensed gaming facilities, off-track betting facilities, restaurants and nightclubs (use registration permits required prior to occupancy). For 3,0 interior and exterior accessory off-street parking spaces and for six (6) off-street loading spaces.

Extension of an open terrace and partial enclosure of the same, to include hvac duct enclosure,with a corresponding ornamental enclosure on the opposite side (size and location as shown on the application). For the extension of existing eat-in restaurant night club with outdoor dining as part of an existing casino complex to include 1,7 slot machines and a nite club on the first floor with accessory offices on the second floor (mezzanine) with accessory storage and food prep throughout, parking spaces 1081 total, 37 accessible and 317 compact spaces. For level ii alterations to existing east west restroom on ground floor, alterations to include the demoltion removal of existing partition walls and fixtures and provide new parition walls, fixtures and furnishes. All work to be done per approved plans. Separate permits required for mechanical, electrical and plumbing work.

For the erection of an detached building w. Off-street private parking lot & erection of one (1) animated illumination roof sign; size & location as shown in approved plans w. Lowest floor elevation (18) inches minimum above base flood elevation. For use as assembly & entertainment casino on the same lot as an exist. Gaming facility, w. Maximum of 17 gaming positions, w. Nightclub & private club, sit-down restaurant, accessory business & professional offices, accessory private parking lot for (1081) on-site spaces & (435) off-site spaces on immediately adjoining lot, including (321) compact spaces & (37) accessible spaces, for a total of (1516) spaces per zoning use registration permit# 269718, & accessory signage.

Erection of a standalone, pre-engineered structure adjoining csino building to be used as a temporary poker room until the permanent poker room is completed as part fo the phase ia expansion project. Structure will be dismantled when permanent poker room opens. Permit application is for building only. Separate permit required for mechanical, electrical and fire protection
